DVRX General Terms of Business and Consumer Information

At DVRX, a bespoke furniture company in the Netherlands, we design engaging furniture built to last. These terms govern all orders placed via our online shop, ensuring clarity for consumers and entrepreneurs alike.
1. Scope of Application
These terms apply to all orders placed through our online shop by consumers (individuals acting for non-commercial purposes) and entrepreneurs (individuals or entities acting for commercial or professional purposes). For entrepreneurs, these terms extend to future business relations without repeated reference. Conflicting terms from entrepreneurs are invalid unless we expressly agree.
2. Contracting Party, Conclusion of Contract, Subject Matter
The purchase contract is with DVRX, the Netherlands. Our online shop’s product listings are binding offers to conclude a contract. You can add items to your cart, adjust entries, and confirm your order by clicking the order button, finalizing the contract upon our confirmation. Ensure your provided email is accurate and not blocked by SPAM filters.
The contract covers the creation and delivery of custom furniture, with details in our product descriptions on the DVRX website.
3. Contract Language, Storage
Contracts are in English. We store the contract text and send order details and terms via email. For security, the contract text is not accessible online post-order.
4. Delivery Terms
Shipping costs, unless free delivery is agreed, are shown in the cart before ordering. Production and delivery start upon payment receipt or order authorization, with times noted in the order confirmation and cart. On average, it takes us two months to craft each piece of bespoke furniture.
Delivery is by courier (small items) or forwarding agent (large items), with appointments arranged for the latter. Two delivery attempts are free; additional attempts may incur a charge. Delivery requires a 2.5m-wide accessible route; beyond the last access point (e.g., car-free zones), customers arrange transport unless DVRX organizes it at extra cost. Self-collection or packing station delivery is unavailable.
5. Payment
Payments are due immediately unless specified. Options include:
Prepayment: We provide bank details via email; goods ship post-payment.
Credit Card: Provide details during checkout; payment is processed post-verification.
PayPal: Redirected to PayPal’s site, you must be registered or register, confirm payment, and we initiate the transaction.
Shop Pay: Processed via ShopPay. Log into your account during checkout to use stored payment details.
Google Pay: Pay online with your Google Pay account.
6. Transport Damage
Consumers: Report obvious transport damage to the delivery agent and contact us promptly. This aids our claims against carriers, though it doesn’t affect your warranty rights.
Entrepreneurs: Risk transfers upon delivery to the carrier. You must inspect goods and report defects per Dutch Commercial Code (Burgerlijk Wetboek). Unreported defects are deemed approved unless hidden and fraudulently concealed.
7. Liability
We’re fully liable for damages to life, body, or health, intentional or grossly negligent breaches, product liability claims, or agreed guarantees. For slightly negligent breaches of key contract obligations, liability is limited to foreseeable damages. We’re not liable for uninterrupted website availability due to internet limitations.
8. Warranty and Guarantees
Statutory defect liability applies. Wood, a natural material, may show color/structure variations or minor warping (up to 1mm/meter), which are standard and not defects. Oiled surfaces may appear uneven. Additional warranty details are on our website.
Entrepreneurs: Only our specifications define agreed quality. Inspect goods within 7 days of receipt, reporting defects in writing. We repair or replace defective items at our discretion; if unsuccessful twice, you may reduce the price or withdraw. Warranty lasts one year from delivery, excluding life-injury damages.
9. Code of Conduct
We adhere to Trusted Shops quality criteria (http://www.trustedshops.com/tsdocument/TS_QUALITY_CRITERIA_en.pdf).
10. Dispute Resolution
The EU’s Online Dispute Resolution platform is at https://ec.europa.eu/consumers/odr/. We’re not obliged or willing to participate in consumer arbitration.
11. Final Provisions
Dutch law applies for entrepreneurs, excluding the UN Sales Convention. For merchants, public law entities, or special funds, the exclusive jurisdiction is our registered office in the Netherlands.
